Welcome to ScaleKeep! These Terms of Service ("Terms") govern your use of our email outbound system setup and consulting services. By engaging with our services, you agree to these Terms.

1. Services Provided

ScaleKeep provides an 8-week consulting service to help businesses set up an in-house email outbound system. This includes:

  • Domain and email account setup

  • Cold email strategy and execution guidance

  • A/B testing and appointment setting (if included in your plan)

  • Weekly consulting sessions

2. Payment & Fees

One-Time Setup Fee:

  • Tier 1: $800 USD

  • Tier 2: $1,250 USD

  • Tier 3: $1,800 USD

Monthly Maintenance Fees:

  • Based on the selected service tier (covering domains, emails, and platform fees)

Additional Fully Outsourced System:

  • Tier 1: $500 USD/month

  • Tier 2: $1,000 USD/month

  • Tier 3: $2,000 USD/month

3. Refund Policy

Based on our initial meeting, we will agree on the number of leads you aim to secure by the end of 8 weeks. If the agreed number of leads is not met, we will refund the difference.
Example: If the target is 30 leads and only 20 are booked, we refund the value of the 10 remaining leads from the one-time setup fee.

4. Client Responsibilities

Clients agree to:

  • Provide accurate business information

  • Follow email marketing laws (e.g., CAN-SPAM, GDPR, PDPA)

  • Cooperate in domain and email account management

5. No Guarantee of Results

While we implement best practices, ScaleKeep does not guarantee specific results, such as email deliverability rates or lead conversion rates. However, if the client provides full cooperation and adheres to all recommendations but the agreed-upon number of leads is not met, we will honor the refund policy as stated in Section 3.

Example: If the target is 30 leads and only 20 are booked, we refund the value of the 10 remaining leads from the one-time setup fee.

6. Limitation of Liability

ScaleKeep is not liable for:

  • Business losses due to email campaigns

  • Third-party service issues (e.g., Stripe, Instantly, email providers)

7. Governing Law

These Terms are governed by the laws of Philippines. Disputes shall be resolved in Philippines courts.
